New York Marijuana News Update Governor Cuomo’s Plan Governor Cuomo is going to propose marijuana regulation. Note, he calls it “regulation” and not “recreation” so as not to remind anyone that marijuana can be fun.  He will propose it as a part of his proposed budget for the 19-20 fiscal year. I have been predicting this for months- since the Governor issued the Health Department’s report ahead of the election to signal his new position on legalization, ahem, I mean regulation.  Because marijuana legalization has a revenue component, Cuomo does not need any legislators to introduce a bill for him.  The state constitution allows him to propose whatever he likes as a part of the budgeting process if it has a fiscal impact, so he can take all the credit. New York Will Screw it Up If you are wondering how it will go, one can expect the state will tax it too high, will allow local governments to pile on and tax it into oblivion, will allow town boards to ban it completely (we have whole towns in NY that are orthodox Jewish and allowed to be segregated if you can believe that) and will not allow…

Widespread Canadian Cannabis Shortage Experts are predicting Canada will suffer a legal weed shortage until at least 2020.  What do Alberta, British Columbia, Manitoba, New Brunswick, Nova Scotia, Quebec, and Saskatchewan have in common?  They have all had serious cannabis shortages. Devastating for Business and Hourly Employees One dispensary took only a few hours to sell out and had to close their doors before lunch on opening day.  This is devastating for the businesses that depend on the predicted revenue and employees who depend on the hours of pay they expected to get. One dispensary suspended online sales because they sold have their inventory online in minutes. Government’s Inaction – Time to Speak Up! Everyone said this wasn’t going to happen, but seriously, the government kills just about everything it touches.  The government doesn’t care about businesses failing or investors’ money going down the drain.  Government has little regard for business and most government employees have never had to make a payroll or pay attention to the bottom line. Instead of re-grouping and re-engineering their processes, they will continue to slow walk the applications for licenses unless they are re-motivated. Convicting Government Incompetence – Time to Speak Up!… 

New York Marijuana News – Legalization Soon

Legalization of Recreational Marijuana Coming Soon Watch for the Governor’s “State of the State” and proposed annual budget presentations early next year.  The Governor usually issues his state of the state address on the first day of the legislative session which in 2019 is January 9.  He has until February 1 to issue his proposed budget.  It’s quite possible he will do both at the same time. Nevertheless, the Governor of NY will almost certainly include revenue-generating marijuana expansion legislation as a part of his 2019-2020 fiscal year proposed budget.  This is his opportunity to issue “his” bill and not just tag along to a legislator’s bill. This Governor will surely want to take 100% credit for it, so I can’t see him missing this opportunity.

List of Medical Marijuana Products Currently Available In NY The NYS Department of Health released a two-year report on the medical marijuana program on 11/14/18.    The report can be found here. The report was required by the law and doesn’t make any solid recommendations to fix the major problem with the program – no weed, no grow your own allowance nothing that will help poor people who need medical marijuana. New York’s Regulated Marijuana Listening Session – Albany

New York’s Regulated Marijuana Listening Session – Albany Yesterday, the first of 15 listening sessions was held in Albany.  The vast majority of speakers were pro-legalization.  Many expressed their wish that the new law should include the permission to grow a few plants at home.  This is especially important to medical marijuana patients.  While there has been one case so far that I know of, where a judge ordered an insurance company to pay for medical marijuana in a Workers Compensation case, generally insurance companies are not covering medical marijuana and it is expensive.  Here is a 5 page Fact Sheet that they shared with participants.  Stay tuned here for more information on NY and NJ legalization news.

NY Marijuana Legalization Study Part 2 of 3 Yesterday I posted a blog about the recently released NY Marijuana Study.  I covered some basics and the health analysis and impacts of legalizing recreational marijuana in New York.  Today’s post is part 2 of 3 and will cover criminal justice and public safety.  I will also cover the economic effects of legalization of recreational marijuana in New York.  You will recall that the report’s conclusion was that it is “less of a question of whether to legalize but how to do so responsibly.” NY Marijuana Legalization and Criminal Justice and Public Safety Driving Impaired: The NY Marijuana report goes into great detail about the impact of marijuana arrests on the population.  One of the most interesting, is the rate of intoxicated drivers. In 2007, 8.6% percent of drivers tested positive for marijuana derivatives. Six years later that increased half again as much to 12.6%.  At the same time, the percentage of drivers testing positive for alcohol declined from 12.4% to 8.3 percent. Interestingly, the rate of intoxicated drivers stayed nearly the same (21% to 20.9%) over that time period,  A fair share of the population was driving on hooch… 

NY Medical Marijuana Producer, Etain Expands to California

In another sign of the cannabis industry’s expansion, a NY medical marijuana producer, Etain has expended into California.  Crain’s reports today that Etain has expanded into California, where they will compete in both the medical and recreational marijuana markets. Etain’s COO, Hillary Peckham said “We always planned to expand outside of New York, and this was the right timing for Etain to manage that,” adding that “it was a good fit in terms of the partners out there.”  Etain will apply for a manufacturing license within six weeks and hopes to be operating on that license in the next six months. They should be able to bring marijuana to market sooner than that though by borrowing an Etain partner’s license.  Recreational marijuana became legal in California on January 1, 2018. NY does not make it easy for patients to get medical marijuana and the products available are the most regulated in the nation and accordingly, some of the most expensive in the nation.  It will be interesting to see what happens to medical marijuana when recreational marijuana is legalized in NY.  One would think that if the recreational marijuana is more affordable, then medical marijuana will take a hit – pun intended. …
